The Turkish judiciary has been on the executive’s agenda since the foundation of the republic, and every government and ideology has tried to influence, direct and manage it in one way or another. However, the judiciary has never been so openly tainted and worked in parallel with, and even under the guidance of, the political administration as it has been during the AKP’s rule.
Much has been said and written about the politicisation of the judiciary, its positioning in line with the objectives of the government, its ‘instrumentalisation’ to suppress dissenting individuals and groups and to silence different opinions. However, the Association for the Unity of the Judiciary (Platform), which plays a crucial role in bringing the judiciary into such a situation that destroys its reputation, destroys its customs and prevents it from working in accordance with its mission, has not been given the importance it deserves.
Mehmet Bakır ÖZKAN and Dr Hasan DURSUN, who are members of our association and worked as prosecutors in the judicial system before 15 July, have written a book entitled “THE SHADOW OVER TURKEYS JUDICIARY ASSOCIATION OF JUDICIAL UNITY”.

In the report, the role of YBD in the process of eliminating judges and prosecutors who are not in contact with the government and the individuals and groups working in harmony with it, and the role it has played in the mass purges in line with the labelling and the subsequent mass purges are discussed and revealed in detail. The activities of the judges and prosecutors who are members of the YBD in the High Council of Judges and Prosecutors, the Court of Cassation, the Council of State, the Constitutional Court, the Supreme Electoral Council and the Ministry of Justice are presented with numerical data.
The fact that a significant number of judges and prosecutors in the Turkish judicial system, such as chief prosecutors, presidents of high criminal courts and criminal peace judges, who have the opportunity to influence the outcome of important investigations and cases, are selected from members of the judiciary who are members or supporters of the YBD is an important point highlighted in the report.
The report is a historical document and contains important information and findings that will shed light on the process of politicisation of the Turkish judiciary and the reasons behind the decisions it makes or does not make.
